Miranda v. Arizona Essay

Early in 1963, a 17 years old woman was kidnapped and raped in Phoenix, Arizona. The police investigated the case, and soon found and arrested a poor, and mentally disturbed man. The name of this man was Ernesto Miranda. Miranda was 23 years old when he was arrested. On March 13, 1963, Miranda was arrested based on circumstantial evidence linking him to the kidnapping and the rape. After 2 police officers interrogated him for 2 hours, he signed a confession to the rape charge. The form he signed included the following statement: â€Å"I do hereby swear that I make this statement voluntarily and of my own free will, with no threats, coercion, or promises of immunity, and with full knowledge of my legal rights, understanding any statement I make may be used against me.† Miranda was not given a full and effective warning of his rights. He was not told of his right to remain silent and his right to counsel. Miranda was found guilty of kidnaping and rape and was sentenced to 20-30 years imprisonment on each count. During the prosecution, Miranda’s court-appointed lawyer, Alvin Moore, objected that because of these facts, the confession was not truly voluntary and should be excluded. In the end of 1966, The Supreme Court, in a 5-4 decision written by Chief Justice Earl Warren, ruled that the prosecution could not introduce Miranda’s confession as evidence in a criminal trial because the police had failed to first informs Miranda of his right to an attorney and against self-incrimination. The Supreme Court of Arizona detailed the principles governing police interrogation. Arizona ruled that detained criminal suspects, prior to police questioning, must be informed of their constitutional right to an attorney and against self-incrimination.

Development Of Christianity

Christianity developed as a combination of Jewish monotheism and Roman universalism. It developed this way because it started out in a society that was anti-Jewish and Roman, and ended in a society that was Roman and Christian. Christians were originally persecuted by the Romans along with the Jews, who also persecuted them. One of the earliest people to spread Christianity to Greece and Asia Minor at the same time was the apostle Paul. Pauline Christianity synthesized the role of Jesus as a divine figure with Greek traditions.Christianity emerged from Judaism, but there are key differences to remember. The Jews view themselves as inheritors of a historical religious tradition that binds their society together no matter where it is. Christian eschatology does not view the coming of God as a historical event. The apostle Paul still left a definitive and lasting impression on Christian history and the way Jesus was thought of by the mass numbers that Paul was able to convert in Greece and Asia Minor.Paul, who received a vision of Jesus that blinded him, and then was miraculously healed, became one of the first Christian evangelists, spreading the word of Jesus throughout his lifetime. Lawrence Venuti is a distinguished translator, translation theorist and master of deconstruction whose works are included in two collections of stories by Dino Buzzati. Venuti is the recipient of a translation grant from the National Endowment for the Humanities and a Premio di Cultura for translation from the Italian Government. A former judge of the PEN-BOMC Translation Award, he teaches at Temple University as an Associate Professor of English. Venuti’s theory has re-analyzed the connotation of translation. He is strongly against domestication of translation, which embodies the ethnocentrism and cultural hegemony in essence. He hopes to make a new position for translation that should be read as a translation with its own value, which not only puts post-modernism in translation but also leaves enough space for Chinese scholars and students to rethink translation. Beside Introduction and Conclusion there are five chapters in this thesis: Introduction briefly introduces the present situation of translation studies and the theme, the structure and goal of this thesis; Chapter One collects and briefly introduces the most important parts of Venuti’s translation theory, trying to find the essence and key points from either textual or non-textual aspects; Chapter Two tries to analyze Venuti’s theory from both diachronic and synchronic perspectives in hope to find the properties in the modern times; Chapter Three integrates theories of different schools and focuses on analyzing the functions of Venuti’s translation theory in translating practice and review through comparative studies. The Message Of Islam Theology The word Islam is derived from the root word salaama means peace, obedience, purity, and submissions. Islam means abiding peace and obedience to the will of God. While other religions derive their name from either a tribe, or a geographical area or a founder, and Islam derives its name from the central ides of peace and submission to god. The followers of Islam call them as Muslims or Musalmans. The word Hindu is derived from the Sanskrit root word Sindhu and used by Persians, ancient Greeks and many foreigners to denote the people who lived beyond the river Indus. The word Hinduism was invented by the british scholars in 1830s to denote the religious traditions of the native Indians to distinguish them from the other recognized religions. The message of Islam came to Muhammad for the first time through the angel Gabriel in 610 A.D., in a cave on Mount Hira. He kept on receiving the answers to his questions rest of his life and then he put all together in the book called Quran, which is the only holy book of Islam. Quran is the only book in the world which cannot be ever translated. Hinduism considers Vedas as their teachings of God. The Vedas are the earliest sacred books of Hinduism. The end part of Upanishads, which constitutes the philosophical base of Hinduism known as Vedanta and contains the elements of monotheism and description of God as the supreme deity of universe. Other important sources of Hinduism are the Vedantas, the Puranas, the Bhagavad Gita, Tantric texts, the Ramayana and the Mahabharata. In Hinduism God is worshipped in many different ways. The daily rituals are performed by an individual several times a day in which offerings are made to gods, the elements, ancestors, animals and the humans. Many people also worship by visiting the temple everyday in the morning. Ramayana states that Wealth springs fr om dharma, from dharma comes happiness and one gets everything from dharma. Dharma is the essence of this world(Valmiki). Pooja is the popular form of worship in which prayers, chants, flowers, incense sticks, and others things are offered to gods, like said in Ramayana Whatever is ones food, the same food shall be offered to ones gods (Valmiki 2.103.30)Some Hindus also participate in satsangs or religious gatherings and perform the singing and chanting of the names of gods. Many Hindus practice fasting on specific days of the weeks or on some festivals. Hindus also visits certain sacred places and temples for their own beings. A visit to Varanasi for a dip in Ganges is considered very purifying and spiritual uplifting. There are many festivals celebrated by hindus out of which some are Diwali, Navaratri, Uttarayan, Ganesh Chaturthi and many more. Muslims deny believing or worshiping any other god but Allah, who is their almighty. He is not only the highest god of muslims, but also of all the people in the world. He is close to his loyal worshippers, whom he forgives their sins and blesses them with peace and happiness. They believe in free will and fate. According to muslims, Allah knows everything that happened, that has been happening and that will happen. He made humans responsible for their actions and choices. Anyone can convert to Islam easily. According to their traditions, anyone who follows Allah and takes Muhammad as his messenger becomes a muslim because Quran says that He who obeys the Messenger has indeed obeyed Allah (al-Nisa 4.80). Hinduism believes in existence of Brahman, the supreme Lord of the universe who is eternal and stable. Three gods Brahma, Vishnu, and Shiva are his three main forms which are endowed with their work of creation, preservation and destruction. According to Hindus, god can be worshipped in too many different ways. Many Hindus worship gods into their personal forms chosen by themselves. Hinduism believes in worshipping god as in the image or the statue or an object. They also believe in peaceful life lived with truth and honor, like once said in Mahabharata, Should even ones enemy arrive at the doorstep, he should be attended upon with respect. A tree does not withdraw its cooling shade even from the one who has come to cut it (12.146.5). And Mahatma Gandhi also said I have no other wish in this world but to find light and joy and peace through Hinduism. Hinduism and Islam believe in the God as a supreme Lord of the universe, and as a creator of the whole system. Both religions believe that god has blessed humans with free will which make themselves responsible for their actions and choices. Allah is known by 99 names and the person who learns them all by heart goes in the heaven. The Brahman of Hinduism also has many names and by chanting them a person can attain him. Both believe that god responds to all the people who worship him and blesses them. Hinduism believes in karma. Islam believes that good rewards for good deeds and punishment for bad dreams. And Quran states Whoever does good deed, he shall be repaid ten-fold; and whoever does evil, and he shall be repaid with evil (5.32). Both religions believe in non-violence and killing no human life. In Hinduism the path of truth is far more important than the belief or disbelief in god. Islam does not recognize any other religions other than they are specifically mentioned in Quran . We believe in that which has been revealed to us and revealed to you, and our God and your God is One, and to him do we submit (29.46). Muslims believe that they in something that is been revealed to them and believe that everybodys god is same. Both religions believe in praying gods and reciting their name and ask for gods forgiveness. Muslims believe in praying only one god Allah, where as Hindus pray to one god but in different forms and incarnations. A person can be converted to Islam by praying to Allah or by taking Muhammad as their own messenger. Whereas in Hinduism a person becomes a Hindu by birth or by personal choice, without taking any messenger or following particular god permanently. Islam does not accept anyone between humans and god and in Hinduism there is a presence of priest for the right directions. Islam does not have any high priest or gurus, whereas Hindus has like the highly respected gurus who people follow and seek for more knowledge from them. Islam does not believe in rebirth. Hindus believe going in heaven or hell but they believe that the soul gets its freedom back through rebirth. Hinduism does not have the concept of messengers like Muslims have Muhammad as their messengers to god. Muslims laws are well versed in Quran as to punish the one who oppose the commands of Allah, and in Hind uism the laws are not imposed by the religious groups or people but are through the government. Standardized Testing Scholar Bill Ayers believes standardized testing in schools does not accurately measure what is necessary to be successful in life. Ayers insists that Standardized tests such as the American College Test (ACT) and the Scholastic Aptitude Test (SAT) measure specific facts and function which are among the least interesting and slightest important information that children should know. In an article titled â€Å"Testing the Right Way for Talent†, written by Hugh Price, argues the fact that standardized tests fail to capture the qualities that are necessary to be successful in the business world. Another article labeled â€Å"Implementing NCLB Assessment and Accountability Requirements in an Imperfect World† composed by Stuart Kahl, is in agreement with both Price and Ayers. According to Bill Ayers, Hugh Price and Stuart Kahl, standardized tests are uncalled excuse for a traumatic and stressful time in a child’s life. Hugh Price and Stuart Kahl are among the large majority of people who do not believe one test is able to accurately measure what a child knows. Price states, â€Å"High-stakes standardized tests, like the Scholastic Aptitude Test, the SAT, fail to capture the qualities most essential for success in the corporate world, such as creativity, drive and leadership† (Price). Price claims that although these tests are able to rate children in topics such as Math, English and History, what really makes one who they are is more than book smarts, but their personality and leadership skills are also necessary. In addition to Price believing this fact, Kahl also articulates against standardized testing. In his article that analyzes The No Child Left Behind Act of 2001, Kahl is aware of the fact that ... ...ort and a motivation behind the tests may as well perform better than those who are not. Whatever the reason may be, many people, including Price, Kahl, and Ayers do not support standardized testing. These authors all have one opinion in common; they are all against testing for the sake of the children, because of the pressures kids already endure without the pressures of testing. They all claim that tests may be an unfair way to rank children in the world today due to: teachers not teaching children the right material in preparation for the test, family upbringing, and even worrying the children would affect the test results. As Ayers indicates, one single test could not determine where a child stands in the business world, due to the fact that the test analyzes specific topics on school and nothing about their personality or more personal traits.

Maus reflection Essay

I do hope that you took the time to enjoy my genre recreation project. The idea was a very spur of the moment decision, and came to me quite suddenly in the middle of Michael’s craft store. My original thought was to create a scrapbook of a certain characters’ life, and make a sort of collage of events surrounding them. Alex Galvin took me to Michael’s the Monday before the project was due, and I spent hours (or so Alex feels) looking around the craft sections at all the different scrapbooks and pages and stamps galore. I picked up almost everything I needed when I wandered over to the woodcraft section- and there it was: a beautiful wooden shadow box. I immediately dropped everything into Alex’s hands and dashed over to it. As I was looking at it I thought, how original†¦ no one else will think to do this, and a brilliant idea formed in my head. Much to Alex’s dismay, I had him put all of my other supplies back where they came from so that I could start on this new idea. My new vision, to create a memorial to Richieu, definitely challenged me to think outside of the (shadow)box. Get it? When taking notes on Richieu, I never learned much about his personal hobbies or what he liked to do as a child, so I could only put general items in the box. I put myself in Anja’s shoes and really thought about what a mother would want to remember about her son. The aspect that challenged me the most was to really think about the pain of losing a child, and if I were in that position, what would I want the memorial to really symbolize? I debated on the newspaper article the longest- did I want to relive the year or Richieu’s birth, or the year of his death? I chose a New York Times page from the year of Richieu’s birth, because it is always better to honor the happiness of birth rather than the death day. Now, you are probably wondering why I chose New York Times instead of a newspaper from their hometown, and you bring up a good point. My thought process for this was that by the time Anja had found out about the death of her son, and had enough time to fully process it, Vladek and her had moved on to America. I imagined that back then, they would not be able to access papers from Sosnowiec, especially anything from before the war, on Richieu’s birth year. I spent ages looking at different background pieces, trying to cut them and shape them to be exactly right, and randomized. I wanted it to look somewhat like a scrapbook, and I felt that Anja would have a bunch of little scraps and not full sheets of paper. I chose darker colors with not as many patterns to enhance the fact that, although we are remembering Richieu, it is still a dark place for Anja. I struggled when it came to the blanket scrap in the top corner. I only used a scrap, because maybe Anja was given the leftovers of Richieu’s blanket, or maybe she cut off a piece before she gave him to Tosha. Either way, the blanket would’ve had to survive the war, so I tried to burn parts of the fabric. Unfortunately, the type of fabric I had did not burn as well as I hoped, but I kept it in the box anyway. I wish I was able to include a train set in my box, because I took notes on Richieu playing with trains. A constraint I had was trying to fit 3-D objects inside, without pushing out the glass or making anything stick out. I also had trouble figuring out where to place everything so I didn’t crowd it and take away from the main point which was the picture in the center. I think that each reader has an expectation of what each genre entails, and each author needs to work with those anticipations. For example in Maus, if Art Speigleman had written a memoir, he wouldn’t be able to incorporate little details in his illustrations. Every frame, the reader can see the body language and facial expressions, which adds a whole new level to the story. If Spiegleman had written a general novel, there would be move filler to create the image of a storyline and not just dialogue. In a memorial box, people expect to see something that relates the deceased persons life, something special that pertains to him/her. Just like writing a regular essay, there are requirements to each project that if they aren’t completed, the genre wouldn’t make sense or it would turn in to something completely different. If you’ve ever read the short essay â€Å"Two Ways of Seeing a River† by Mark Twain, he brings up a good point about literature that I relate to genre. He makes a point to say that dissecting literature will take away from the essence of the piece as a whole. He talks about the river losing beauty and grace, simply because he studied it for so long and knows every bit of it. I believe that people who read simply for the pleasure of reading can see the beauty of genre without having any expectations or decoding it. Each genre opens up a new â€Å"river† and something new for each person to enjoy. I hate writing, simply because I don’t appreciate the beauty of putting each word on paper and I have only written essays for the majority of my life. I welcomed this project because it gives the sense of a different perspective of writing, and therefore opened my eyes to a new â€Å"river†. Each person responds differently to different types of genre, and I think that the answer is in the question. Genre doesn’t change the overall meaning of a piece, but it can add or take away details depending on the constraints, and different genres mean something different to each person. I have never done a genre remediation before, and I struggled with the concept of what it was. I thought I had to rewrite Maus into a completely different genre and I couldn’t wrap my head around how to do that. I loved the chance to explore something more creative and not only writing essays. This helps us get a better grasp on different types of genre instead of just have a teacher preach about different styles, we get to experience it ourselves. The revolutions in the area of information and communications technology have brought the world closer. Literally, the world has shrunk because people from Europe can readily communicate with people from Asia; a daughter in the United States can easily contact her parents in South America. The mobile phone networks, the chat rooms and instant messengers in the internet, together with e-mail have significantly lowered the cost of inter-continental communications and have literally transcended space and time.In addition to this revolution, there is also a great deal of developments in the technologies available to humans in doing their chores and conducting their businesses. Even the simplest task can be automated and would require only a touch of a button for it to function. Washing machines, refrigerators and all sorts of electronic gadgets and equipments have indeed made life easier. This is especially true in the case of developed countries where these technologies are readily avai lable.Life has no hassles and lifestyles have become as easy as pushing another button on the remote control of the television. In less developed countries, however, this is not the case. The tendency is for them to rely on traditional means of doing things and conducting their business. Most of these countries in Asia, Africa, and South America doe not have access to most of these new technologies. As a result, they still tend to use their own bodily strength in conducting their businesses and going about their daily lives.For example, in farming, people from less developed countries use their own muscles and animals to till the soil and harvest their agricultural products later on. On the other hand, those in the developed countries tend to use heavy machinery to conduct the same set of activities. Has the use of technology led people and society to become lazy, apathetic and disconnected to the rest of the world? What about individuality?
